Lawyer: No proof teller engaged in fraud
PORUS, Manchester:
A waste of time is how one attorney is describing the Manchester Municipal Corporation multimillon-dollar fraud trial as the defence continued to make their no-case submissions on Wednesday.
Representing accused former bank employee Radcliffe McLean, attorney Joel Nelson stated that the Crown had not built a credible case to impute ill intention on the part of his client, which would warrant the charge of defrauding.
He went further to state that the inherent weaknesses of the prosecution’s case proved that not even a properly led jury could convict on the evidence presented.
McLean is being accused of facilitating the encashment of fradulent cheques, but Nelson maintained yesterday that the prosecution had failed to prove that the cheques were, in fact, fradulent and that his client knowingly conspired with other accused.
He made reference to the evidence given by a representative from the bank to which McLean was employed, highlighting that her testimonies did not confirm any irregularities on the part of his client.
The prosecution is expected to make their response today when the matter resumes in the Porus Court.
