The police personnel charged in relation to the death of construction worker Mario Deane are to go on trial in the St James Circuit Court in September.

When the case resumed in the St James Circuit Court today, presiding judge Sandria Wong-Small ruled against a no-case application by attorneys for Corporal Elaine Stewart and district constables Juliana Clevon and Marlon Grant who are charged with manslaughter, misconduct in a public office and perverting the course of justice.

Wong-Small said she found that there is evidence of a breach of care that was owed to Deane on the day in question.

The accused are to reappear in court on Monday, May 7 for a committal hearing to facilitate the transfer of the case to the Circuit Court.

Their bails were further extended.

The cops were on duty at the time Deane was allegedly beaten by other inmates in a cell at the Barnett Street police lock-up in Montego Bay on August 3, 2014.

It is being alleged that following the incident Stewart instructed that the cell be cleaned before the arrival of investigators from oversight body the Independent Commission of Investigations.
