‘Chucky’ Brown Trial | Witness oblivious to some details of plea agreement

The Crown’s final witness in the trial of police Constable Collis ‘Chucky’ Brown seemed to have been caught by surprise this morning after it was revealed that he could be recalled for sentencing if he did not give the evidence that was expected.

Brown is being tried for the 2009 murder of Robert ‘Gutty’ Dawkins and the 2012 murders of Dwayne ‘Murderous’ Douglas and Andrew Fearon.

As the trial continued in the Home Circuit Court in downtown Kingston, Brown's Attorney Norman Godfrey asked the witness, “Is it a part of the plea deal that if you don’t give the evidence expected of you, you could be recalled for sentencing?”

“No sir, I don’t know what you are talking about,” the witness responded.

He was then handed a copy of the plea agreement that he is said to have made with the Director of Public Prosecutions on October 23, 2018, and asked to read a section of the document.

The question was then again posed to the witness by Godfrey.

The witness responded, “I did not read that. That was not said to me. That’s the justice system’s work.”

Godfrey also asked, “Is Mr Brown mentioned in your several witness statements touching the details of Fearon and Douglas?”

But, the witness did not appear to understand the question.

“You are trying to confuse my brain. Who is Mr Brown?” the witness asked.

Godfrey then said, “I am going to disappoint you. I take no responsibility for your confusion.”

The attorney pressed on, asking the witness if he was aware of gun offences that ‘Murderous’ attempted to commit in St Elizabeth.

“He was going to rob your client’s ‘don’ based on my information,” the witness said.

Godfrey also asked him if he told anyone in authority about the attempted robbery and the kidnapping of a young woman in Manchester to which the witness answered in the affirmative.

“I did. I did. Positively sure sir. Very much positive,” the witness said.

The witness also testified that Brown introduced him to a senior police officer at the May Pen Police Station four to five days after the deaths of Douglas and Fearon and collected money from him.

In addition to the murder charges, Brown is also facing one count of wounding with intent and another of conspiracy to commit murder.
