'Chucky Brown' Trial | Judge rejects defence's no-case submission

The no-case submission made by defence attorneys in the trial for murder accused police Constable Collis ‘Chucky’ Brown has been rejected.

Presiding judge, Justice Vivene Harris, who made the ruling, cited that the evidence presents a prima facie case, which means it is sufficient to establish a fact or raise a presumption unless disproved or rebutted.

The submission was made by attorney Norman Godfrey in the absence of the jury at the Home Circuit Court in downtown Kingston.

Godfrey was seeking to have two counts removed from the five-count indictment.

Brown is being tried for the 2009 murder of Robert 'Gutty' Dawkins and the 2012 murders of Douglas and Andrew Fearon. Both incidents happened in Clarendon.

He is also facing three charges of murder, one count of conspiracy to commit murder and one count of wounding with intent.

The defence will start presenting its case on Monday.
