Licensed firearm holder freed of murder charge
The prosecution has offered no evidence in the murder case against 56-year-old Averton Roy, a Jamaican residing in Canada.
Roy, who is a licensed firearm holder, was charged with the murder of Niguel Jihan Deason, a Jamaican residing in England who was fatally shot in Linstead, St Catherine on December 31, 2018.
The incident took place outside a nightclub and attorney-at-law Hugh Wildman, who represented Roy, said that when the closed circuit camera was viewed it showed clearly that Deason was the aggressor.
Wildman wrote to the Director of Public Prosecutions Paula Llewellyn asking that Roy be freed because he was acting in self-defence.
Yesterday, the prosecution offered no evidence against Roy when the case was brought before the Home Circuit Court.
On the night of the incident, Roy in the company of two women had gone to the nightclub.
It was alleged that Deason who previously had a relationship with one of the women was upset when he saw her.
Roy and the women left the club but Deason followed them and began to beat the woman.
When Roy asked Deason why he was beating the woman, he punched him several times.
Another man joined Deason in punching Roy who then pulled his firearm and fired one shot hitting Deason.
The Crown offered no evidence on the basis that it could not argue against self-defence.
