St Catherine man gets two years' probation for having sex with underaged girl

A man who pleaded guilty to having sexual intercourse with a person under 16 years old was given two years' probation in the St Catherine Circuit Court on Friday.

He is Gerald Humes, 20 years old, of Planters district, St Catherine.

Attorney Tana Scarlett made an impassioned submission on behalf of Humes for a non-custodial sentence.

"Your honour as a result of the unfortunate circumstances, he now has a son to care for, therefore a custodial sentence would not assist. He is remorseful and has a good community report and is at the court's mercy," Scarlett said.

Justice Bertram Morrison told the defence that Humes would benefit from his early guilty plea and good antecedent and probation report.

The court heard that the accused got sexually involved with the complainant and the matter was reported to the Old Harbour police.

He was later charged.
