Unfortunate headline

This was a most unfortunate headline, Mr Editor. You make it sound as though the DPP had asked Judge Pusey to end the Kern Spencer trial. There were two different issues. The DPP asked the judge to recuse herself and the defence asked that the case should be thrown out.

One gets this only from reading you total article - a good one - but you must try to avoid misleading or ambiguous headlines.

Stupid judges

The problem with all this is the higher court pettiness, really stupid judges. There are all kinds of legal tools available to address this dispute but our judges are real boneheads. Take, for instance, the doctrine of necessity. Is it not necessary for the court to settle this dispute so the case can move forward? Bottom-line mandate of the court in a civilised society is that every case must move forward with the aim of settling issues in the quickest time and with least cost.

Tell me, then, how the dickens this dispute could be premature when it was taken to the higher court. Necessity demands that it is addressed when it gets there, and the court there take the opportunity to set jurisprudence as to procedure so next time the law is in place. What a waste of taxpayers' money and precious court time!

I hope everyone takes note that, by international standard (we have none), this time-consuming wrangling could well work to the accused's favour. Drawn-out trials are known to be ruled against basic human-rights law - cruel and inhumane treatment. They all, especially the higher court, should be ashamed.

DPP should recuse herself

The DPP seemed to be suffering from a case of 'attention seeking, spotlight grabbing deficit disorder'. Why she doesn't recuse herself from the case so that justice can be served in honour of the Jamaican people is beyond my comprehension.

This is not fair to the Jamaican people, the judge, and also the defendants, who are entitled to a fair trial and justice for the Jamaican people.
