After more than 30 years in prison, a Florida man was set free yesterday after a DNA test showed he did not kidnap and rape a 9-year-old boy in 1974.

James Bain, now 54-years old, was 19 when he was convicted on charges of kidnapping, burglary and strong-arm rape.

He had been sentenced to life imprisonment.

For years Bain had been trying to get the state authorities to conduct DNA testing to prove his innocence.

After four failed attempts an Appeal court ruled that he was entitled to a hearing to challenge his conviction.

Following a DNA testing the court was told that his sample did not match the sample taken from the victim at the time of the incident.
