Australian swimmer Ryan Napoleon will find out on Monday if his doping ban for using a wrongly labeled asthma inhaler has been set aside, allowing him to swim at the Commonwealth Games.
The Court of Arbitration for Sport heard Napoleon's appeal today and scheduled its ruling next week.
FINA suspended Napoleon for three months in August despite acknowledging that a pharmacist's mistake led to his positive test for the banned drug formoterol.
FINA says its doping panel imposed the ban to "underline the responsibility of the athlete to check his medicine."
Australia selected Napoleon to swim the 400 and 1,500-metre freestyle races at the October 3-14 games in New Delhi.
