CCJ grants TCL special leave

The Trinidad-based Caribbean Court of Justice (CCJ) has granted special leave to Trinidad Cement Limited (TCL) and TCL Guyana Incorporated to pursue a case against the Guyana government.



This is the first such judgement to be delivered by the regional court in its original jurisdiction, under which the CCJ is mandated to settle disputes arising out of the CARICOM Treaty.



The two companies had applied to the CCJ seeking the Court’s permission to sue the Republic of Guyana for alleged breach of the Revised Treaty of Chaguaramas.



They are challenging a unilateral decision by the Bharrat Jagdeo administration to suspend the Common External Tariff on cement imported from countries outside of CARICOM.



The companies are seeking millions of dollars in damages.
