Policewoman freed of negligence charge
Police corporal Janice Cogheil who had her service weapon stolen from her car in April 2016 was today freed of a charge of negligence in the Kingston and St Andrew Parish Court.
She was freed after an application by her defence team that the charge of negligent lost of a firearm should be dismissed because the circumstances do not support the charge.
The court was told that Cogheil went to a supermarket in Harbour View, St Andrew to purchase items and on returning to her car she discovered that the vehicle was broken into.
Several items including her government-issued gun were missing.
She was subsequently arrested and charged with the negligent loss of a firearm under the Firearms Act.
It was argued in court that neither that Act nor the Jamaica Constabulary Force Act provided for circumstances where a firearm issued to a member of the constabulary force is negligently lost.
The court agreed and upheld the application freeing the policewoman.
