Millwood off to Privy Council

The National Transport Cooperative Society (NCTS), has filed an application in the Court of Appeal seeking leave to the Privy Council to hear the matter over breaches of a bus franchise agreement.



The Court of Appeal is to hear the application on Monday.



In May, the government won the 10-year legal battle with the Ezroy Millwood-led company.



It followed the Government\'s 2001 take-over of the public transportation system in the Kingston Metropolitan Transport Region in a bid to rationalise the sector.



In 2003, an arbitration panel led by retired Court of Appeal Judge, Boyd Carey ruled that a $4.5 billion award be set aside for damages.



However the ruling was overturned a year later in the Supreme Court by Justice Patrick Brooks, who also ruled that NTCS pay the Government\'s legal fees.



In June 2004, the $4.5 billion award, which would have been applicable for the years 1995 to 2001, would have amounted to $8 billion.



The NTCS was responsible for providing public transportation up to March 2005, but this ended in 2001.
