Court rules VMBS liable

The Court of Appeal has ordered that damages must be assessed in the civil suit, which senior citizen Barbara Berry brought against the Victoria Mutual Society (VMBS).
Berry had sued the VMBS for negligence after she fell and fractured her right foot and also sprained her left ankle.
She was injured while conducting business at the VMBS Half Way Tree branch in St. Andrew in July 1998.
Berry was going down a step from the customer service area to the banking hall when she fell.
She said there was no warning sign indicating that there was a step in the vicinity, but VMBS had denied liability.
Late last year, the Supreme Court ruled that VMBS was to be held liable for the woman’s fall.
