Stern’s dual citizenship case

The Court of Appeal is now hearing legal arguments in the dual citizenship case brought against North West Clarendon MP Michael Stern by the PNP candidate, Richard Azan.



The court is to determine whether Mr. Stern was served with further particulars after the election petition was filed in the Supreme Court.



Mr. Stern is contending that he was not served with the particulars, which should have informed about the reason for the petition.



If the court rules that Mr. Stern was not served with the particulars, then it is likely that his election petition will be thrown out.



This is because the time would have by now expired for Mr. Azan to file them.



The Court earlier ruled that Mr. Stern should not pursue the point in which he was contending that the address to which the petition was served was not similar to what he had on his nomination paper.



Mr. Stern said on his nomination paper his address was Main Street Frankfield P.O, Clarendon, while on the registered mail to which the petition was sent, the address was 18 Main Street, Frankfield P.O, Clarendon.



Azan is contending that under the constitution, Stern should not be elected to the House of Representatives because he holds dual citizenship.
