INDECOM did not ignore court ruling

THE EDITOR, Sir:

An article published in The Gleaner on March 23, 2018, asserted that the Independent Commission of Investigations (INDECOM) attempted to contravene the judgment of the Court of Appeal. This is inaccurate and misleading.

INDECOM did not seek to circumvent the ruling of the second highest court. A warrant was issued by a justice of the peace, on March 1, 2018, for the arrest of the woman constable and a court date for appearance set for March 20. The Court of Appeal judgment was subsequently delivered on March 16. Further, the court did not address the issue of arrest by warrant.

The warrant was directed to a named individual and can be executed by the person named or, in accordance with Section 16 of the Jamaica Constabulary Force (JCF) Act, by any member of the JCF.

When an arrest is done under a warrant, it is done under the authority of a justice of the peace issuing the warrant.
