Incompetence or bias?

"Considering the conduct of the trial judge, the fair-minded and informed observer would have a reasonable apprehension or suspicion of bias and, as such, public trust in the judicial process is under threat."

That is a profound statement and I would have to agree, especially with the last part about public trust. Justice must not only be done, but it must be demonstrated to have been done.

It does appear that the resident magistrate is hard on the prosecution. The question is: is it because of incompetence on the part of the prosecution, or is it bias?

I don't know - but it does seem so. Here is the important point. I could be wrong - but in the eyes of at least one person in the public, there seems to be a bias.

It is not so important whether the perception is right or wrong. The trouble is that there is indeed such a perception. As such, getting another RM cannot hurt.

Remove both judge and DPP

In the interest of the Jamaican people and also to ensure that the defendants get a fair and impartial trial, both the judge and the director of public prosecutions should be excused from this case.

Who is on trial?

I am wondering who is on trial. It seems like there are two cases going on at the same time - Spencer against the people, and the DPP against the judge. Is this what is happening?
