Gym instructor freed

A 28 year old gym instructor Steven Dixon, of a Kingston address, has been freed of charges of wounding with intent and illegal possession of firearm.



He was arrested and charged in March last year, arising from an incident on January 10, 2007 in which another gym instructor was shot and injured in New Kingston.



The Crown\'s case was that Dixon and the complainant had an argument and both men began to fight.



During the fight, a man who had accompanied Dixon to the area pulled a firearm and shot the complainant in the chest.



Dixon in defending himself in the Gun Court said that he went to speak to the complainant about problems involving other gym members.



He said he did not know that the man had a firearm and he did not tell him to shoot the complainant.



Defence lawyers Tom Tavares Finson and Peter Champagnie submitted that Dixon should be freed because he was not part of a common design to shoot the complainant.



Mr. Justice Lennox Campbell upheld the submission and freed Dixon.
