Stern appeal hearing continues
Attorney at law Abe Dabdoub is today expected to continue his submissions in the Appeal Court in the election petition case involving North West Clarendon MP Michael Stern and the PNP’s candidate, Richard Azan.
Dabdoub is representing Azan. Stern is seeking to strike out Azan\'s claim in relation to an election petition alleging that he has dual citizenship.
The North West Clarendon Member of Parliament is also seeking to go to the Privy Council for a determination as to when an election petition is deemed served.
Stern had contended in his appeal last year that he was not served with additional information in relation to the petition within the specified time in law.
The law and the constitution state that the Court of Appeal is the final court for election petitions.
But attorney at law, Kirk Anderson who represents Stern, says the Court of Appeal should grant the application to the Privy Council because in Stern\'s case the petition has not yet been heard and determined.
He is arguing that on points seeking clarification on certain issues in an election petition, an appellant has a right to go to the United Kingdom Privy Council.
Attorney-at-law Abe Dabdoub who is representing Azan is opposing the application for leave to go to the Privy Council.
